We strongly suspect that federal agencies like the FDA may also take regulatory action against this product, especially considering the excessive levels of Lead and Arsenic detected. Why Is This Product Still Legal Under FDA Standards?
This product remains legal because, under current FDA classifications, fluoride-free toothpastes are categorized as cosmetics. Cosmetics can legally contain up to 10,000 parts per billion (ppb) of Lead—equivalent to 10 parts per million (ppm). In contrast, Washington State’s new Toxic-Free Cosmetics Act, effective from January 2025, restricts Lead content to a maximum of 1,000 ppb (1 ppm).
